While my heart is still with film, I've been playing around a fair bit lately with iPhone photography, and have been having a lot of fun with it. Headwaters Art Festival

My response to the draconian photographic waiver

I provided this to the organizer of the building tour I was hoping to go on, copied to the member of the restoration corporation I was previously dealing with. Original posting here.
"On account of the absurd requirement by the Richardson Center Corporation to sign away the copyright on any photographs that might be taken on the Richardson tour, I will not be attending the tour. Please make my spots available to someone else.
I cannot put it more bluntly: This photographic waiver requirement is absolutely ludicrous. The terms of the contract are those commonly found where photographers are HIRED and compensated to produce photographs. These are absolutely not conditions that are common or appropriate for consideration to simply visit a publicly owned historical venue for a tour. The signing away of copyrights without compensation is insulting to photographers. This is particularly insulting given that this event was promoted as an event for "shutterbugs", amateurs and professionals alike. I appreciate that you have no choice in agreeing to implement this draconian requirement.
I wish you all the best on the event. I presume that the pent up demand to see this building will result in many photographers willingly signing over what is rightfully theirs. But not me. As an artist, doing so is unacceptable... and as an artist, my copyright is all I have. "
How not to write a photography waiver
I was just presented with a photography waiver for an event I was hoping to attend on Sunday. And event promoted for professional photographers, and photographers in general, or just to the general public who is interested in the unique venue. Permission was given to a space that in the past was only available to those would risk getting arrested to get inside.
The restoration corporation that controls access wants to restrict the use of photographs taken in the building, which is reasonable. But to say that the terms of the waiver were overly draconian is an understatement. It is, frankly, offensive and a slap in the face of attendees. Specifically:
1. All photos taken pursuant to this agreement shall become the exclusive property of (the Corporation). (The Corporation) shall be deemed the author of such photos for all purposes, including the registration of copyrights.
2. (The Corporation) hereby grants to Photographer a royalty free license to use the photographs taken by Photographer pursuant to this agreement: (1) on the photographer’s personal or professional websites or social media sites; and (2) to display the Photographer’s work to the public. Any use of the photographs in a manner not permitted by this License is expressly prohibited.
It was said that they consulted other historic sites and that this was language that they found elsewhere. I have literally photographed in dozens of these kinds of places and signed many waivers over the years, and never ONCE have I been presented with a waiver as overreaching as this one. It is absolutely ridiculous to the point that I'm not sure if I will attend at all.

This weekend's Toronto Outdoor Art Exhibition was fantastic. I was happy to meet everyone who came by my booth and to talk about photography. Thanks to everyone who picked up a business card, or who took the time to tell me they liked my photos. I appreciated it all.

Pop-Up Gallery Exhibition - One Night Only, gallerywest, Toronto

Toronto Outdoor Art Exhibition - July 8-10
